- General
1.1 These Terms and Conditions apply to all sales of Goods and Services supplied by Peacock Turfscape (“we”, “us”, “our”).
1.2 By placing an Order with us, you (“the Buyer”, “you”, “your”) agree to be bound by these Terms and Conditions.
1.3 These Terms may only be varied in writing and signed by a Director of Peacock Turfscape.
1.4 If you are purchasing in the course of your business, you are contracting with us on a business-to-business basis.
- Interpretation
In these Terms:
- Acknowledgement – written confirmation that we are able to process your Order.
- Contract – the legally binding agreement between you and us.
- Goods – the products supplied by us.
- Order – your request to purchase Goods and/or Services.
- Price – the price confirmed at checkout or in our written Acknowledgement.
- Services – any services provided by us.
- Working Day – Monday to Friday, excluding public holidays in Scotland.
- Formation of Contract
3.1 An Order placed via our website is an offer to purchase.
3.2 A Contract is formed when we issue written confirmation or dispatch the Goods.
3.3 We reserve the right to refuse or cancel any Order at our discretion. Where payment has been taken, a full refund will be issued.
- Pricing & Payment
4.1 Prices shown on our website are exclusive of delivery unless stated otherwise at checkout.
4.2 Payment for online orders must be made at the time of ordering via Stripe, PayPal or other methods offered on our website.
4.3 We reserve the right to amend prices at any time prior to Order confirmation.
- Product Information & Natural Variations
5.1 Many of our products are natural materials. Decorative aggregates, soils, bark, sand, and salt may vary in colour, texture and grain size. Images on our website are for guidance only.
5.2 Turf is a natural, living product and may vary slightly in colour and appearance depending on season, weather and growing conditions.
- Turf-Specific Conditions
6.1 Turf is freshly harvested to order and is a perishable product.
6.2 Turf must be laid immediately upon delivery or collection. We recommend it is laid within 24 hours.
6.3 Once delivered or collected, turf becomes the responsibility of the customer. We cannot accept liability for deterioration caused by:
- Delayed laying
- Inadequate watering
- Improper preparation or installation
- Extreme weather conditions
- Environmental or site conditions beyond our control
6.4 Any concerns regarding turf quality must be reported within 24 hours of delivery or collection. Photographic evidence may be required.
6.5 Due to the perishable nature of turf, cancellations must be made at least 24 hours prior to the agreed delivery or collection date.
6.6 Where insufficient notice is given, we will attempt to resell the harvested turf and refund any quantity successfully redistributed, but this cannot be guaranteed.
6.7 Any concerns regarding turf performance must be raised within 1 month of purchase, although we cannot accept liability for failure caused by aftercare or site conditions beyond our control.
- Delivery
7.1 We will endeavour to deliver on agreed dates but are not liable for delays caused by circumstances beyond our control, including weather, traffic, mechanical breakdown or supply chain issues.
7.2 Standard delivery is to the nearest safe kerbside or hard standing area. Drivers cannot move goods:
- Up or down steps
- Across soft or uneven ground
- Through buildings
7.3 Deliveries are typically made by LGV vehicles equipped with HIAB or Moffett offloading equipment. Occasionally, we may use third-party hauliers.
7.4 It is the customer’s responsibility to:
- Ensure suitable access for delivery vehicles
- Inform us of access restrictions
- Be present to accept and sign for delivery
7.5 If delivery cannot be completed due to access issues not disclosed in advance, we reserve the right to cancel the Order or charge a failed delivery fee.
7.6 We reserve the right to cancel delivery where transport costs exceed those reasonably available through our haulage network.
- Risk & Responsibility
8.1 Risk in the Goods passes to the customer upon delivery or collection.
8.2 After this point, we are not liable for loss, damage or deterioration.
- Complaints & Faulty Goods
9.1 Any complaint regarding non-perishable goods must be made within 48 hours of delivery or collection.
9.2 Complaints should initially be reported by phone and must be confirmed in writing via email.
9.3 Goods claimed to be faulty may need to be returned for inspection before a refund or replacement is issued.
- Cancellations & Returns
10.1 Consumer customers have the right to cancel non-perishable goods within 14 days under the Consumer Contracts Regulations 2013.
10.2 Perishable goods (including turf) are exempt from cancellation rights once harvested or dispatched.
10.3 Returned goods must be:
- Unused
- In resaleable condition
- Returned to our correspondence address
10.4 Delivery charges are non-refundable. Collection of returns may incur a charge.
10.5 Refunds will be processed once goods are received and inspected.
10.6 These Terms do not affect your statutory rights.
- Company Premises
11.1 All visitors must comply with health and safety requirements while on site.
11.2 We accept no responsibility for injury or damage to persons, vehicles or equipment while on our premises, except where caused by our negligence.
11.3 Once goods have been loaded onto a customer’s vehicle, responsibility transfers to the customer.
- Website Use
All website content is provided for general information only. We make reasonable efforts to ensure accuracy but do not guarantee that information is complete or current.
We are not liable for losses arising from use of the website, except where liability cannot be excluded by law.
- Limitation of Liability
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot legally be excluded.
Our total liability shall not exceed the value of the Goods supplied.
- Governing Law
These Terms are governed by Scots Law. Any disputes shall be subject to the jurisdiction of the Scottish courts.
